JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER (Per: HONOURABLE THE CHIEF JUSTICE) 05-09-2017 The inter se dispute of seniority between the parties herein now is only of academic interest as the respondents have attained the age of superannuation and have retired. As far as the legal issue is concerned after the orders were passed in CWJC No.130 of 2005, the legal issue has already been decided by a Co-ordinate Bench of this Court in LPA No.963 of 2007 on 09.11.2015 in favour of the State Government, and, therefore, now no further indulgence into the matter is called for.

Patna High Court LPA No.1318 of 2005(11) dt.05-09-2017 2/2 In view of the above, the law laid down in LPA No.963 of 2007 shall be made applicable in such cases.
