The petitioner is accused in connection with Panjwara P.S. Case No.103 of 2019 registered under Section 399, 402 of the Indian Penal Code and 25(1-b)A,26/35 of the Arms Act. The accusation is that in course of patrolling duty seven persons tried to escape after seeing the police vehicle but they were apprehended with the motorcycles. On query they disclosed their name Chandan Yadav, Guddu Yadav, Dharmendra Kumar (petitioner), Pradeep Yadav, Chhotu Kumar, Kanhaiya Kumar and Monu Kumar. Petitioner was found in possession of one country-made pistol and one live cartridge. Learned counsel for the petitioner submits that the petitioner has no criminal antecedent and is in custody since 20.09.2019.
