2. Petitioner apprehends arrest in a case registered for the offence punishable under section 74 and 78 of B.N.S., 2023 and Sections 8 and 12 of the POCSO Act.
3. As per the prosecution case, petitioner who is teacher of the school in question is alleged to have sexually assaulted the victim and indulged in committing obscene act with her.
4. On perusal of the records, it appears that during investigation witnesses have corroborated the allegations

No.1461 of 2026(6) dt.22-06-2026 2/2 levelled against this petitioner and it has been disclosed that petitioner was caught by the local police when he was fleeing away from the spot. The statement of the victim and witnesses shows that petitioner committed the aforesaid with sexual intent. It is also evident that petitioner is teacher in the same school where victim is studying, such obscene acts alleged to have been committed also amounts to gross misconduct on the part of the petitioner.
5. Considering the nature of accusation and gravity of offence, prayer for pre-arrest bail of the petitioner is rejected. (Prabhat Kumar Singh, J) Koushik/Alok RajU T
