The petitioners are languishing in custody in a case registered for the offences punishable under Sections 414/34 of the Indian Penal Code.

It is alleged that petitioners were caught with stolen motorcycle.

It is submitted by learned counsel for the petitioners that petitioner are innocent and they have falsely been implicated in this case. Nothing has been recovered from the conscious possession of the

Patna High Court CR. MISC. No.4104 of 2024(2) dt.06-02-2024 2/2 petitioners. The petitioners have no concern with the seized motorcycle. The petitioners are languishing in custody since 17.09.2023.

In contra, learned A.P.P appearing on behalf of the State has vehemently opposed the prayer for bail of the petitioners.

Considering the facts aforesaid and the period under custody, let the petitioners, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousands) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, 1st, Gopalganj in connection with Kuchaikote P.S. Case No. 471 of 2023.
