JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 25-01-2019 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Barun P.S. Case No. 97 of 2018 for the offence under Sections 147, 148, 149, 341, 323, 324, 307, 332, 333, 353, 395, 436, 504, 120B of the Indian Penal Code and Section 3/4 of Prevention of Damage of Public Property Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent and he is in custody since 12.12.2018. He submits that in fact, the instant case was registered by the police against 200 people, who created nuisance on the road near Dumar Dihra More for which large number of people assembled there and made protest on account of death of injured.

Considering the fact that the petitioner has got no criminal antecedent and the petitioner, who was not named in the F.I.R., is in custody since 12.12.2018, he is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad in connection with Barun P.S.
