JUSTICE DINESH KUMAR SINGH ORAL ORDER 19-02-2015 Heard learned counsels for the petitioners and the State. The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 324, 307, 379 and 504/34 of the Indian Penal Code. It is alleged that the petitioners entered into the house of the informant who happens to be the aunt of the petitioner no.1 and started assaulting the informant and when niece of the informant came to rescue then petitioner no.1 inflicted knife blow over her neck causing cut injury, thereafter, when the informant went to rescue her niece, then she was also caused knife injury when petitioner no.2 snatched gold chain from the neck of the informant. Petitioner no.2 is the mother of petitioner no.1. It is submitted by learned counsel for the petitioners that
Patna High Court Cr.Misc. No.6483 of 2015 (2) dt.19-02-2015 2/2 due to petty dispute, the accusation has been levelled and the injuries of the informant and her niece have been found to be simple in nature caused by hard and blunt substances. A statement has been made in para 3 of the petition that the petitioners have no criminal antecedent.
Considering the injury report not corroborating the accusation of assault with knife, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned C.J.M., Gopalganj in connection with Uchakagaon P.S. Case No. 168 of 2014, subject to the conditions as laid down under Section 438(2) Cr.P.C.
