The petitioner seeks bail in Sitamarhi P.S. Case No. 787 of 2014, registered for the offences punishable under Section 392 of the Indian Penal Code.

The informant made allegation that while he was going on an auto rickshaw, two passengers were sitting therein from before and they snatched his bag containing Rs. 60,000/-. The informant further alleged that the driver of the auto rickshaw also fled with the accused persons who robbed him. Learned counsel for the petitioner submits that the petitioner is the driver of the auto rickshaw. His auto rickshaw was stolen and later on he came to know that his auto rickshaw was parked in a police station. When the petitioner went to see his auto

Patna High Court Cr.Misc. No.6742 of 2015 (3) dt.06-04-2015 2/2 rickshaw the petitioner was apprehended. The petitioner was not put on test identification parade and he is in jail since 12.09.2014. It appears that the petitioner is the driver of the auto rickshaw and there is no allegation against him that he committed robbery, but the informant alleged that the petitioner being the driver of the auto rickshaw also fled away along with the robbers. The petitioner was not put on test identification parade and he has also got no criminal antecedent.

Considering the facts aforesaid and the fact that the petitioner has already remained in jail for about seven months, he above named is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Sitamarhi in connection with Sitamarhi P.S. Case No. 787 of 2014.
