The petitioner is languishing in custody since 04.08.2014 in a case registered for the offences punishable under Sections 307/34 of the Indian Penal Code and 27 of the Arms Act. Three miscreants fired at the informant causing injury on the neck and left hand. FIR was lodged against unknown. Name of the petitioner sprang up during investigation. It is submitted by learned counsel for the petitioner that the petitioner was not put on TIP and he has been roped in the present case only because he has serious criminal antecedent. Petitioner is accused in 17 other cases, but similarly

Patna High Court Cr.Misc. No.7202 of 2015 (02) dt.02-03-2015 2/2 situated accused Ramjee Rai @ Ramji Rai, having 18 cases against him, has been granted bail vide Cr. Misc. No. 5935 of 2015.

Considering the aforesaid facts, let the above named petitioner, be released on bail on furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Sitamarhi in connection with Dumra P.S. Case No. 223 of 2013. Considering the criminal antecedent of the petitioner, the learned court below will be at liberty to cancel the bail bonds of the petitioner, if he substantially gets involved in some serious nature of the offence or defaults for two consecutive occasions.
