The petitioner seeks regular bail in a case registered under Sections 307, 379, 34 of the Indian Penal Code. The F.I.R. was lodged against the petitioner and others. It appears that during the course of investigation, names of the Arun Singh, Varun Singh and Prem Shankar Singh also figured in the case. The informant alleged that Tarun Singh fired at the right eye of the informant while Varun Singh and Prem Shankar Singh facilitated the crime.

It is submitted that during the course of investigation, the investigation of the petitioner was kept pending and chargesheet was submitted only against Prem Shankar Singh. The petitioner was summoned under Section 319 Cr.P.C during the

Patna High Court Cr.Misc. No.5971 of 2015 (2) dt.12-02-2015 2/2 course of trial.

It appears that accused Arun Singh and Varun Singh have already been enlarged on bail vide order passed in Cr. Misc. No. 38195/2014.

Considering the fact that there is no specific allegation of firing against the petitioner, the above named petitioner is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Ad hoc Addl. Sessions Judge II, Sitamarhi in Sitamarhi P.S. Case No. 492 of 2011. (Prabhat Kumar Jha, J) Dilip/- U T
