2. In this case, the petitioner is seeking regular bail in connection with Sherghati P.S. Case No. 761 of 2022, registered for the offences punishable under Sections 147, 148, 149, 387, 326, 504 of the Indian Penal Code and Section 27 of Arms Act.

3. As per allegation, five named accused persons came to the biscuit factory of the informant and demanded ransom. The allegation against co-accused Gatauri Bhuiyan is that he fired shot and injured the son of the informant. The specific allegation against the petitioner is that he assaulted the informant with badhari and sword.

4. The learned counsel for the petitioner has submitted that the petitioner is innocent and has falsely been

Patna High Court CR. MISC. No.828 of 2025(2) dt.28-02-2025 2/2 implicated in this case. The allegation against him is general and omnibus. He is under custody since 23.10.2024. He has also submitted that on exactly similar footing, co-accused Sanjay Kumar has been granted regular bail by this Court vide order dated 17.05.2023 in Cr. Misc. No. 13638 of 2023.

Considering the above-mentioned facts and circumstances, let the petitioner above-named be released on bail on furnishing bail bonds of Rs.10,000/- with two sureties of the like amount each to the satisfaction of learned ACJM 1st, Sherghati at Gaya in connection with Sherghati P.S. Case No. 761 of 2022, subject to the following conditions:- (i) The petitioner shall cooperate in the disposal of trial and make himself available as and when required by the court.

(ii) If the petitioner is found involved in future in the similar type of offense, the prosecution will have liberty to file an application before the court below for cancellation of the bail of the petitioner and the learned court below will take decision in accordance with law.
