2. The petitioner seeks bail in a case registered for the offences punishable under Sections 30(a)(b)(c) of the Bihar Prohibition and Excise Act.

3. Learned counsel for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. He submits that there is no recovery from the conscious possession of the petitioner rather 15 litres of country made liquor is said to have been recovered from the house of the petitioner. He submits that the petitioner has 18 criminal antecedents as mentioned in para-3 of this application and he is languishing in judicial custody since 23.10.2024.

4. Learned APP for the State opposed the prayer

Patna High Court CR. MISC. No.613 of 2025(2) dt.12-02-2025 2/2 for bail.

5. Considering the facts and circumstances of the case and the criminal antecedent of the petitioner, in am not inclined to enlarge the petitioner on bail. Accordingly, his prayer for bail is rejected in connection with Sare P.S. Case No. 155 of 2023.

6. However, petitioner is at liberty to renew his prayer for bail after framing of charge.
