This application is filed for grant of regular bail in connection with Islampur P.S. Case No. 646 of 2021 registered under section 366(A) of the Indian Penal Code. The prosecution story is short is that one Chandan Kumar (Petitioner) took the daughter of the informant on motorcycle and fled away.

The girl in her statement made under Section 164 of the Cr.P.C. has accepted the fact that she was having an affair with the petitioner and there is no allegation of any sexual act

Patna High Court CR. MISC. No.2081 of 2023(3) dt.25-05-2023 2/2 against the petitioner and he is in custody since 30.11.2022. Learned A.P.P. has vehemently opposed the prayer for bail.

Considering the period of custody and the allegation levelled against the petitioner, this application for regular bail is allowed.

Let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional District Judge-cum-Special Judge, POCSO in connection with Islampur P.S.
