Accordingly, it stands dismissed as withdrawn in connection with Banka Mahila P.S. Case No. 26 of 2019, pending in the Court of the Subdivisional Judicial Magistrate, Banka.

Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the state.

The petitioner no. 1, Laxmi Devi, seeks pre-arrest bail in connection with Banka Mahila P.S. Case No. 26 of 2019, registered under Sections 498A and 34 of the Indian Penal Code

Patna High Court CR. MISC. No.92 of 2020(2) dt.06-02-2020 2/2 and 3 and 4 of the Dowry Prohibition Act.

The accusation is of torturing of informant by her husband and in-laws due to non-fulfillment of demand of dowry and removing her from matrimonial house.

Submission is that petitioner no. 1, Laxmi Devi, is the mother-in-law of the informant and she has falsely been implicated in this with ulterior motive. Further, submission is that Vivekanand Yadav, husband of the informant, is in custody. Having regard to the facts and circumstances of the case, let the petitioner no. 1, Laxmi Devi, in the event of surrender/arrest, within a period of four weeks from today, in connection with Banka Mahila P.S. Case No. 26 of 2019 shall be released on bail on furnishing bail bond of Rs.10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of the Subdivisional Judicial Magistrate, Banka or the successor Court subject to the conditions as laid down under Section 438(2) Criminal Procedure Code.
