This is an application for bail in connection with Pirpainty P.S.Case No. 114 of 2016, corresponding to Sessions Trial No. 680 of 2016/Trial No. 145 of 2016, registered for the offences punishable under Sections 302, 201 and 120B/34 of the Indian Penal Code.

Petitioner is named in the FIR. Though there is allegation that petitioner had taken the deceased along with him but FIR itself shows that petitioner along with others was conspirator in killing the deceased.

It has been submitted on behalf of the petitioner that except suspicion there is nothing against the petitioner and he is in custody for about 10 months.

Having heard both sides and from perusal of the impugned order it appears that now trial has commenced and allegation against the petitioner is on the basis of strong suspicion, I am not inclined to grant bail to the petitioner. Prayer for bail is rejected.

However, as the trial has commenced, learned trial court is directed to expedite the trial and try to conclude it within a period of nine months. If the trial is not concluded within the said period, petitioner may renew his prayer for bail. (Vinod Kumar Sinha, J) spal/- U
