Mr. Shyam Kumar Singh, APP ====================================================== CORAM: HONOURABLE MR. JUSTICE BIRENDRA KUMAR ORAL ORDER 27-08-2021 Heard the parties in virtual Court proceeding. The petitioner is languishing in custody for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act, 2016, Sections 353/414 of the Indian Penal Code and Sections 25(1-b)a/26/35 of the Arms Act. Submission is that so far petitioner is concerned allegation is that only two cartridges were recovered from his possession. The petitioner is in custody since 26.09.2020. Other recoveries are from possession of other co-accused. Considering the facts aforesaid, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Jogbani P.S. Case No. 228 of 2020 corresponding to Special Case No.786 of 2020 with following conditions:

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
