The petitioners seek regular bail in connection with Excise case (Gaya) No. 292 of 2021 lodged under Section 30(a) of Bihar Prohibition and Excise Amendment Act, 2018. It has been alleged in the F.I.R. that total 1602 liters of excise material has been recovered from possession of the petitioners.

Learned counsel for the petitioners submits that the alleged recovery was not made from the conscious possession of the petitioners. He further submits that petitioners have clean antecedent. Charge sheet has already been filed and they are

Learned A.P.P. has opposed the prayer for bail. Considering the facts of the case and after perusal of the records as well as this aspect that charge sheet has already been submitted, petitioners are languishing in jail since 24.10.2021 and they have clean antecedent, let the petitioners above named be granted bail on furnishing bail bond of Rs.10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District & Sessions Judge-II-cum-Special Judge, Excise Act, Gaya in connection with Excise Case (Gaya) P.S.
