The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 147, 148, 149, 341, 323, 504, 353, 307, 188, 270 and 271 of the Indian Penal Code and 3/ 4 of the Bihar Epidemic Disease COVID-19 Regulation 2020.
The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent and the informant alleges that he along with the police force had gone to the vegetable market Simri for getting the COVID-19 guidelines implemented when it is alleged that the accused persons including the petitioner opposed, assaulted and brick-batted the police as they were opposing the closure of the shops.

No specific overt act has been alleged against the petitioner. It is further submitted that the allegations are general and omnibus in nature.
The learned Additional Public Prosecutor opposes the anticipatory bail application.
Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks from today, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 5,000/- (Rupees Five Thousand) with two sureties of the like amount each to the satisfaction of learned Court below where the case is pending in connection with Aurai P. S. Case No.85 of 2021, subject to the conditions laid down under Section 438(2) of the Cr.P.C.
The application stands allowed.
