The petitioner apprehends his arrest in Morhowrah (Madhaura) P.S. Case No.622 of 2020, registered for the offences punishable under Sections 341, 323, 324, 307, 447 and 34 of the Indian Penal Code.

Allegation against the petitioner is that he pierced Barchhi in the stomach of the informant.

Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the present case. It is submitted that there is case and counter case between the parties. It is further submitted that the occurrence took place on 29.06.2020 and the FIR was lodged on 12.07.2020. There is no explanation regarding the delay in lodging the FIR.

Patna High Court CR. MISC. No.12715 of 2021(2) dt.03-12-2021 2/2 Learned APP for the State opposed the prayer for anticipatory bail of the petitioner.

Considering the fact that there is delay in lodging the FIR, let petitioner, above named, in the event of his arrest or surrender before the learned court below within a period of six weeks from the date of receipt of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.25,000/- (rupees twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Morhowrah (Madhaura) P.S. Case No.622 of 2020, subject to the conditions laid down under Section 438(2) Cr.P.C.
