The petitioners are apprehending their arrest in connection with Rajeev Nagar P.S.Case no.376 of 2018 , registered for offences punishable under Sections 346, 323, 354, 385, 387, 430, 467, 468, 471,120B of the Indian Penal Code. Allegation against the petitioners as per FIR is that Raghunath Prasad purchased the land from Vidyavati Devi on power of attorney and later on using the power of attorney he transferred the same in the name of his wife as such they have tried to dispossess the informant from the land and they have also demanded Rangdari form the informant.
Submission of the learned counsel for the petitioners is
Patna High Court Cr.Misc. No.4254 of 2019(3) dt.22-02-2019 2/3 that they are not related with Raghunath Prasd or Vidyawati Devi rather they are Gotiya and no specific allegation has been attributed against the petitioners.
Heard learned A.P.P. and the learned counsel for the informant. They have opposed the prayer for bail stating that the petitioners and other accused persons are trying to dispossess the informant from the land which is purchased land.. Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, in the event of arrest or surrender before the court below within a period of six weeks from the date of order be released on bail on furnishing bail bond of Rs.25,000/- (Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of the learned Sub Judge III cum ACJM, Patna in connection with Rajeev Nagar P.S.Case No.
376 of 2018, subject to condition as laid down under Section 438 (2) of the Code of Criminal Procedure with condition that they will not create any obstruction in possession of the informant in this case until the same is finally adjudicated by a court of competent jurisdiction otherwise the informant is free to move before the learned court below itself for cancellation of their bail bond.
