====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 29-06-2021 Heard learned counsel for the petitioner and the State. The petitioner seeks regular bail in Bihariganj Police Station Case No. 20 of 2019 registered for the offences punishable under sections 366A/34of the Indian Penal Code. As per the prosecution case, petitioner along with other three co-accused named in the FIR, kidnapped informant's daughter aged about 14 years with intent to marry. Learned counsel for the petitioner submits that FIR has been lodged after dealay of 12 days without giving cogent explanation. The victim had voluntarily fled away from the house. Petitioner has got clean antecedent as stated in paragraph 3 of the bail petition. Petitioner is in custody since 18.1.2020. Learned counsel for the State opposes the prayer for bail and submits that the victim in her section 164 Cr.P.C.

Patna High Court CR. MISC. No.12294 of 2021(2) dt.29-06-2021 2/2 statement has alleged that the petitioner took her out of the house at 3 am, first made her unconscious and then took her to Ambala.

In view of the specific allegation against the petitioner of kidnapping of a minor girl, his prayer for bail is refused.
