JUSTICE VINOD KUMAR SINHA ORAL ORDER 30-01-2019 This is an application for grant of anticipatory bail in connection with Khajekalan P.S. Case No. 262 of 2018, disclosing offences under Sections 498A, 504 of the Indian Penal Code and Section 3⁄4 of the Dowry Prohibition Act. Allegation against the petitioners, who happens to be mother-in-law and married Nanad respectively of the informant, is of subjecting cruelty and demand of rupees five lacs. Submission of learned counsel for the petitioners is that they are living separately from the informant/complainant and no specific allegation has been attributed against them. Further, they have no criminal antecedents.

Having heard both sides, considering the above submission, this application is allowed. Let the petitioners, above named, in the event of their arrest or surrender before the court below within six weeks, be released on bail on furnishing bail bond of Rs. 25,000/- (Rupees Twenty Five Thousand) each with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, Patna City, in connection with Khajekalan P.S. Case No. 262 of 2018, subject to the condition laid down under Section 438(2) of the Code of Criminal Procedure.
