The petitioner seeks bail in Madanpur P.S. Case No. 274 of 2018 GR No. 1943/2018, registered for the offence punishable under Sections 364, 302/34 of the Indian Penal Code, section 27 of the Arms Act and section 17 of the Criminal Law Amendment Act.

As per the prosecution case, three FIR named accused persons took away the husband of informant and thereafter it is alleged that informant's husband was shot dead. It is submitted on behalf of the petitioner that though petitioner is named in the FIR, but no specific overt act has been alleged against him. From bare perusal of FIR, it appears that 28 persons are named in the FIR whereas, 50-60 persons are unknown and there is general and omnibus allegation. Similarly

Patna High Court CR. MISC. No.2404 of 2022(2) dt.24-03-2022 2/2 situated co-accused has been granted bail by this Court vide order dated 02.01.2020 passed in Cr. Misc. No. 26677 of 2019. Other co-accused persons have also been granted bail by different Benches of this Court. Petitioner claims clean antecedent and he is in custody since 14.09.2021. Considering the facts and circumstances of the case, the petitioner above-named, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Aurangabad in connection with Madanpur P.S. Case No. 274 of 2018.
