The petitioner is apprehending his arrest in connection with Chapra Muffassil P.S.Case no. 296 of 2018 registered for offences punishable under Sections 394 and 302 of the Indian Penal Code.

FIR discloses that the dead body of the brother -in-law of the informant was found at the four lane of south of Mala Gaon village. His brother-in-law had gone to Siwan carrying a DCM vehicle bearing Registration No. BR01GF 1628 loaded with Dalda but some one has killed him and during the investigation one co-accused Jalandhar Das @ Santosh Das has made confessional statement stating that he along with the petitioner and others intercepted the vehicle, killed the deseased and took away the vehicle and later on at his instance the vehicle was

Patna High Court CR. MISC. No.7286 of 2019(5) dt.09-05-2019 2/2 recovered and that clearly shows that 91 bags of Dalda has also been handed over to the petitioner.

Submission of the learned counsel for the petitioner is that except the confessional statement thee is nothing against the petitioner and he has falsely been implicated in this case. Heard learned A.P.P. also.

Having heard both sides as well as the investigation is going on, I am not inclined to grant privilege of anticipatory bail to the petitioner, however, the petitioner is directed to pray for regular bail, which will be considered by the learned court below on its own merit.
