2. 01-02-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

Petitioner, in the present case, is seeking regular bail in connection with Jamui P.S. Case No. 323 of 2017 registered for the offence punishable under Sections 147, 148, 149, 332, 353, 153(A), 295(A), 435, 427, 307, 337, 338, 323 of the Indian Penal Code and 27 of the Arms Act.

Learned counsel for the petitioner submits that from perusal of the F.I.R. it will appear that the allegation against this petitioner is that of being a member of the mob only there is no specific allegation of committing any overt act against the petitioner. Learned counsel also submits that in the nature of the case other accused persons similarly situated have been granted privilege of regular bail.

Patna High Court Cr.Misc. No.4763 of 2018 (2) dt.01-02-2018 Learned Additional Public Prosecutor for the State opposes the prayer for regular bail.

Considering the facts and circumstances of the case and materials on record, let the petitioner, above named, be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rupees ten thousand only) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Jamui, in connection with Jamui P.S. Case No. 323/2017, subject to condition as laid down under Section 437(3) of the Code of Criminal Procedure.
