The petitioner is apprehending his arrest in connection with C1 2496 of 2015 Tr. 1061 of 2017 registered for offences punishable under Section 498(A) of the Indian Penal Code. Allegation against the petitioner is of demanding Rs.60,000/- for a motorcycle and Rs.2.5 lack for business and torturing as well as subjecting her cruelty.
Submission of the learned counsel for the petitioner is that he is still ready to keep her.
Heard learned A.P.P. and from perusal of the impugned order, it appears that the complainant has categorically stated that the petitioner has taken her to his house but she has not been provided meal and she was brutally assaulted.
Patna High Court Cr.Misc. No.4653 of 2019(2) dt.29-01-2019 2/2 Having heard both sides and considering the aforesaid facts and circumstances as stated above, I am not inclined to grant anticipatory bail to the petitioner, however, the petitioner is directed to surrender before the learned court below within a period of six weeks from the date of order and make prayer for regular bail, which shall be considered by the learned court below on its own merit without being prejudiced by the order of this Court.
With the aforesaid observation, this application is dismissed.
