JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-02-2015 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 23.12.2014 in a case registered for the offences punishable under Sections 409, 120 B of the Indian Penal Code.

Petitioner was senior teacher of the concerned school and it is alleged that he along with principal and other accused defalcated the government money to the tune of rupees two lacs and odd.

The contention on behalf of the petitioner is that it was principal of the concerned school who was entrusted for construction of the building and petitioner had no concern with the execution of the concerned scheme.

Considering the aforesaid facts and circumstances as

Patna High Court Cr.Misc. No.5123 of 2015 (2) dt.09-02-2015 well as period of detention of the petitioner in jail custody, let the petitioner be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Maushami Singh, Judicial Magistrate 1st Class, Munger in connection with Asarganj P.S. Case No. 44 of 2014.
