The petitioner has prayed for regular bail in a case instituted for the offence under Sections 406, 419, 420, 467, 468, 471, 120B and 34 of the Indian Penal Code. The informant, who is an ASI, along with his police force had proceeded to conduct a raid at the house of the petitioner, after getting information that the petitioner along with another co-accused was cheated people by organizing illegal lucky draw. Patna High Court CR. MISC. No.3035 of 2023(3) dt.04-05-2023 2/3 conducted at the house of co-accused namely, Bharat Kumar, from whom many mobiles as also one note book containing mobile numbers of several persons were recovered and data has been made available by the petitioner.

It is submitted by learned counsel for the petitioner that petitioner has been falsely implicated in this case. He has committed no offence. He submitted that not a single incriminating article has been recovered from the possession of the petitioner nor at his instance. All the articles which have shown to have been recovered from the house of the petitioner belongs to the petitioner himself i.e., debit cards, mobile phones, Sim cards etc. He further submitted that the other co-accused has already been granted bail by a Co-ordindate Bench vide order dated 20.01.2023 passed in Cr. Misc No. 48991 of 2022. He is languishing in judicial custody since 20.10.2022. The application for bail is opposed by learned APP for the State.

Having heard learned counsel for the parties and considering the facts and circumstances of the case, this court is inclined to enlarge the petitioner on bail. The above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Rs. ten thousand only) with two sureties
