Perused the office note dated 31.07.2017 and the record. It appears that the suit was decreed as per judgment under appeal. The plaintiff, Most. Mundrika Devi was held entitled to half share in the suit property. Against the said judgment, the original defendant Saudi Mahto and his son Banaras Mahto filed this appeal impleading the plaintiff as respondent no.1 and his minor son and grandsons as respondent nos.2 to 4. The respondent no.1, Most. Mundrika Devi was the sole plaintiff who had contested the case with the present appellant. The remaining respondent nos.2 to 4 are son and grandsons of original appellant no.1, Saudi Mahto. The respondent no.1, Most. Mundrika Devi

Patna High Court FA No.875 of 1972 (44) dt.08-03-2018 has died and prayer has been made to dispose of the appeal in view of the fact that nobody is there to contest the appeal.
