JUSTICE SATYAVRAT VERMA ORAL ORDER 04-03-2022 Heard learned counsel for the petitioner and learned A.P.P. for the State through virtual court proceedings. The petitioner seeks bail in connection with Bounsi P.S. Case No. 160 of 2021 instituted for the offences under Sections 30(a) and 32(3) of the Bihar Excise Act. Learned counsel for the petitioner submits that the petitioner is in custody since 24.07.2021, is a person with clean antecedent and charge-sheet has been submitted in the case. Learned counsel for the petitioner submits that the allegation is of recovery of 621.6 litres of liquor from a pickup van.

Learned counsel for the petitioner submits that the petitioner is the driver of the pickup van and as such was not knowing what was kept in the pickup van by the owner of the

Learned A.P.P. for the State opposes the prayer for bail of the petitioner.

Considering the fact that the petitioner is in custody, is a person with clean antecedent and charge-sheet has been submitted in the case, let the petitioner above named be released on bail on furnishing bail bond of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge-IIcum-Special Judge (Excise), Banka in connection with Bounsi P.S. Case No. 160 of 2021 (Satyavrat Verma, J) Rishi/- U T
