Heard learned counsel for the petitioner and learned A.P.P for the State.

The petitioner seeks bail in Khaira P.S. Case No. 199 of 2005, registered for the offence punishable under Section 364/34 of the Indian Penal Code.

Earlier the bail application of petitioner was rejected vide order dated 23.10.2019. Vide order dated 04.08.2021, report was called for regarding the stage of trial and same has been received (kept at flag 'A'), which reveals that case is pending at the appearance stage. Non-bailable warrant has been issued and process under Section 82 Cr.P.C and process under

Patna High Court CR. MISC. No.12499 of 2021(3) dt.15-09-2021 2/2 Section 83 Cr.P.C have also been issued, but execution report is still awaited.

This petitioner has been arrested and remanded in this Court on 06.12.2018 in this case registered in the year 2005. Considering the nature of accusation and the stage of trial, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
