JUSTICE ADITYA KUMAR TRIVEDI ORAL ORDER 04-03-2015 Heard learned counsel for the petitioner, learned Additional Public Prosecutor as well as learned counsel representing the informant.

There happens to be claim and counter claim over possession relating to Khesra No.1233 during course thereof, there happens to be allegation and counter allegation regarding firing resulting injury to Nitish Kumar as well as Heena Devi and for that petitioner had filed Khagaria (Muffasil) P.S. Case No.562 of 2014 while he is under custody in counter case bearing Khagaria (Muffasil) P.S. Case No.563 of 2014. From the order impugned, it is evident that injured have been examined under para-88 of the case diary wherefrom it is evident that he had not specified his assailant.

In the facts and circumstances of the case, petitioner

Patna High Court Cr.Misc. No.4196 of 2015 (3) dt.04-03-2015 Raja Ram Yadav is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each, to the satisfaction of learned Chief Judicial Magistrate, Khagariya in connection with Khagaria (Muffasil) P.S. Case No.563 of 2014.
