JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-03-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offence punishable under Section 304(B)/34 of the Indian Penal Code.

Petitioner happens to be husband of the deceased, who died in other than natural circumstance. There is allegation of torturing as well as demand of dowry and admittedly, deceased died at her matrimonial home within one year of marriage. In course of investigation, the witnesses supported the prosecution case and the postmortem report also corroborates this fact that death of the deceased was unnatural.

Considering the aforesaid facts and circumstances as

Patna High Court CR. MISC. No.136 of 2020(3) dt.19-03-2020 2/2 well as submissions of the parties, I am not inclined to release the petitioner on bail and accordingly, his prayer for bail in connection with Bounsi P.S. Case No. 12 of 2019 pending in the court of learned Additional Chief Judicial Magistrate-I, Araria stands rejected for the present.
