The petitioner seeks bail in Mohiuddinnagar P.S. Case No. 210 of 2014 registered under section 414 of the Indian Penal Code.

Police raided the premises and apprehended two persons namely Nirbhay Kumar @ Kari and Avinash Kumar. They were found in possession of two motorcycles but did not produce any papers.

Learned counsel for the petitioner submits that Avinash Kumar was also apprehended with motorcycle and he has already been granted bail vide order passed in Cri. Misc. No. 1680 of 2015. The case of the petitioner stands on same footing.

Patna High Court Cr.Misc. No.5345 of 2015 (2) dt.09-02-2015 2/2 Except the fact that one more motorcycle was recovered from the house of the petitioner although the first motorcycle was recovered from the public place and not from the exclusive possession of the petitioner.

Considering the aforesaid facts , the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of Judicial Magistrate, Ist Class, Samastipur in Mohiuddinnagar P.S.
