The petitioner seeks bail in connection with Wazirganj P.S. Case No.322 of 2019 registered for the offence punishable under Sections 147, 148, 149, 341, 323, 354, 379 307 of the Indian Penal Code, which is pending in the court of A.D.J.-12, Gaya.

The petitioner's prayer for bail was earlier rejected on 08.01.2021 in Cr.Misc. No.31440 of 2020. He has renewed his prayer for bail.

Under the last order, the Court had requisitioned a report from the trial court. The report indicates that prosecution evidence was closed on 07.09.2022 after examination of nine witnesses. The report dated 07.09.2022 further specifies that the

Patna High Court CR. MISC. No.1862 of 2022(5) dt.03-01-2023 2/2 matter is pending for statement under Section 313 Cr.P.C. on a next date, which was stated to be 14.09.2022. In view of the aforesaid progress in the trial, which apparently by now must be on the verge of completion, this Court is not inclined to take a different view as regards the petitioner's bail, since rejection under the earlier order was after due consideration of the matter on merits.

The bail application is rejected.

The learned trial court, if the trial is not concluded till date, should proceed expeditiously to ensure its conclusion without granting undue adjournments or any unnecessary delay. (Madhuresh Prasad, J) PNM U T
