The petitioner is apprehending his arrest in a case registered under Section 420 of the Indian Penal Code and 7 of Essential Commodities Act.
The prosecution case, in brief, is that on search of the premises of M/S Ganpati Flour Mill, situated at Ward No. 48, Shekha Bigha, 25.5 quintals of Arwa rice and 142 quintals of wheat were recovered.
It has been submitted on behalf of the petitioner that there is no allegation of tampering of witnesses alleged against the petitioner. The petitioner has been falsely implicated in the present case. The petitioner is owner of a rice mill. 25.5 qunitals of Arwa rice and 42 quintals of wheat are alleged to have been
Patna High Court Cr.Misc. No.4401 of 2019(2) dt.29-01-2019 2/2 recovered. The said food grains had been purchased by the petitioner, which is evident from Annexure-2 series. On behalf of the State, it is submitted that the petitioner is named in the Complaint Case/F.I.R.
Considering the aforesaid facts and circumstances, let the petitioner, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-8, Gaya in connection with Buniyadganj P.S. Case No. 210 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. (Sudhir Singh, J) A.K.V.//- U T
