Heard both sides.
Petitioner seeks bail in a case under Sections 395 of the Indian Penal Code.
The petitioner is not named in the first information report and nothing has been recovered from his possession. The name of the petitioner figured in the confessional statement of co-accused and on such, the petitioner was apprehended on 3.10.2014 and till date, he has not been put on test identification parade. Except confessional statement of the co-accused, there is nothing to involve the petitioner in committing dacoity of a truck loaded with food grains. The petitioner has no criminal antecedent. Considering the facts aforesaid, the petitioner, named above, is directed to be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sub Divisional Judicial Magistrate, Sherghati (Gaya) in connection with Sherghati P.S.Case No. 227 of 2014.
