The petitioners are apprehending their arrest in a case registered under Sections 341, 323, 324, 307/504 of the Indian Penal Code.

The prosecution case, in brief, is that while the informant was cleaning grass and branch of bamboo in her field, the accused persons started hurling her and on protest, she was assaulted, as a result of which, she sustained injury. It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. There is no allegation of tampering of witnesses alleged against the petitioners. The petitioner No. 2 is a lady. The nature of injury is

Patna High Court Cr.Misc. No.7793 of 2019(2) dt.19-02-2019 2/2 said to be simple in nature. No offence u/S 307 of the Indian Penal Code is made out. There is case and counter case between the parties.

On behalf of the State, it is submitted that the petitioners are named in the Complaint Case/F.I.R.

Considering the aforesaid facts and circumstances, let the petitioners, above named, in the event of arrest/surrender before the learned court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-XV, Gopalganj in connection with Kateya P.S. Case No. 09 of 2018, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
