JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 14-02-2020 Heard learned counsel for the petitioner, the State, Patliputra University and the Magadh University. Learned counsel for the Magadh University submits that the entitlement of the petitioner comes to around 30 lakhs and odd which requires approval of the State Government. He
Patna High Court CWJC No.563 of 2020(2) dt.14-02-2020 2/2 submits that the process of calculation and demand for release of the fund will take some time.
Considering the aforesaid, the Court grants four weeks time to the University to calculate the entitlement of the petitioner and raise demand to the State Government. The Court hope and trust that the State Government on raising such demand will release appropriate fund within three weeks from the date of receipt of demand for release of such fund and on receipt thereof the University will ensure payment to this petitioner. Entire exercise in this regard must be completed by the respondents including the Financial Adviser and Finance Officer of the University within a maximum period of three months from the date of receipt/production of a copy of this order.
So far as the entitlement determined vide Annexure-7 is concerned, the Court on perusal of the entire records comes to the conclusion that the petitioner is entitled to counting his service w.e.f. 18.8.1980 instead of 10.5.1983. To that extent Annexure-7 stands quashed.
