The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 392 of the Indian Penal Code.

Prosecution case in brief is that three miscreants came on a motorcycle and looted away cash of Rs.24,700/- along with mobile phone of the informant on the point of pistol. It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the name of the petitioner surfaced on the basis of confessional statement of apprehended co-accused Raunak Kumar and no looted article was recovered from the

Patna High Court CR. MISC. No.1930 of 2022(2) dt.13-06-2022 2/2 conscious or constructive possession of the petitioner. Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, above named in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Sitamarhi in connection with Sahiyara P.S. Case No. 36 of 2019, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
