Petitioner is accused in connection with Sessions Trial No. 20 of 2016 arising out of Dariyapur P.S. Case No.198 of 2015 registered under Sections 147, 148, 149, 323, 341 and 302 of the I.P.C.

Learned counsel appearing on behalf of the petitioner submits that earlier prayer for bail of the petitioner was refused by this Court after taking into consideration the allegation to the effect that Satyendra Sah, Yadu Sah, Dineshwar Sah and this petitioner caused injury to the deceased vide order dated 04.02.2016 passed in Cr. Misc. No. 50728 of 2015, while three others were allowed bail. Further, submission is that petitioner has

Patna High Court Cr.Misc. No.28745 of 2016 (2) dt.03-08-2016 2/2 no criminal antecedent and is in custody since 20.07.2015. It is also submitted that similarly situated co-accused Satendra Sah has already been allowed bail by a Bench of this Court vide Cr. Misc. No. 54407 of 2015 on 19.04.2016.

Having considered the facts and circumstances of the case, let the above named petitioner be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Additional Sessions Judge-VI, Saran in Sessions Trial No. 20 of 2016 arising out of Dariyapur P.S. Case No. 198 of 2015.
