The present writ petition has been filed by the petitioner for a direction to the Circle Officer, Shivsagar, Rohtas, Sasaram (respondent No.3) to issue rent receipt in favour of the petitioner with regard to the land appertaining to New Khata No.164 (Old Khata No.125), New Plot No.229 (Old Plot No.108), area 0.38 decimal, which is alleged to have been purchased by the ancestor through registered sale deed dated 24.02.1960 and paying the rent to the State of Bihar till 1970 as per Jamabandi No.171.

3. Learned Counsel for the petitioner submits that it is the purchased land of the petitioner in the year 1960 and up to the year 1970 the petitioner has paid the rent. But due to mistake of the authority, revisional survey records of right were recorded in the name of "Anabad Surva Sadharan". Counsel submits that before Consolidation Officer representation was filed and correction was made in the name of the petitioner and Chakbandi Khatiyan Prapatra-17 was prepared in the name of the petitioner but the petitioner's name was not entered by the Circle Officer.

4. Learned Counsel for the petitioner submits that petitioner is innocent villager and poor farmer. He was under impression that the order of Chakbandi Officer has come in his favour and that is sufficient. But when he received the knowledge that still the land is "Anabad Surva Sadharan" recorded in the revisional revenue records of right, thereafter he filed a representation before the Circle Officer, Shivsagar, Rohtas, in this matter. He filed representation (Annexure-P/4) but till date no decision has been made. Counsel for the petitioner submits that his representation is still pending.

5. In this view of the matter, this Court without applying his mind on merit and demerit of the case, directs the

Patna High Court CWJC No.1010 of 2025(2) dt.28-01-2025 3/3 Circle Officer, Shivsagar, Rohtas, to pass order on the petitioner's representation within 90 days from the date of receipt/production of a copy of this order.

6. With this direction, this writ petition is disposed off.
