The petitioner seeks bail in connection with Bind P.S. Case No.193 of 2025 registered for the offence under sections 126(2), 115(2), 118(2), 109, 351(2), 352 and 3(5) of the B.N.S., 2023.

The petitioner is alleged to have inflicted sword blow upon the brother of the informant. The petitioner is in custody since 10.10.2025 having clean antecedent. 4.

It has been submitted by learned counsel for the petitioner that the petitioner is innocent and has falsely been implicated in this case due to previous enmity. He further submits that the allegation made in the F.I.R. does not support from the injury report.

Learned APP for the State and the informant have vehemently opposed the prayer of the petitioner for grant of bail.

Though the allegation against the petitioner is of inflicting sword blow but the injury report says that the victim has sustained simple injury caused by hard and blunt substance.

Considering the aforesaid facts, this bail application is allowed.

Let the petitioner, above named, be released on bail upon furnishing bail bonds of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, 1st Class, Nalanda at Biharsharif / concerned Court below, in connection with Bind P.S. Case No.193 of 2025, subject to the condition that he will co-operate in the trial and will appear personally or through his advocate on each and every date fixed in the trial.

It is clarified that this Court has not expressed any opinion on the merits of the case and the observations made by this Court is only for the purpose of deciding this bail application.
