====================================================== CORAM: HONOURABLE DR. JUSTICE RAVI RANJAN ORAL ORDER 19-04-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in a case registered for offence punishable under Sections 272/273 & 308 of Indian Penal Code and Sections 30, 38 and 41 of Bihar Excise Amendment Act, 2016.

It is contended that, as per allegation, 23 liters of foreign liquor was recovered from the paddy field of co-accused Krishna Bin, who has already been granted bail by a co-ordinate Bench of this Court vide order dated 6.04.2018 passed in Cr. Misc. No.19057 of 2018. Nothing has been recovered from the physical possession of the petitioner. It is urged that the petitioner is in custody since 16.01.2018. It is claimed that his antecedent is clean.

Considering the facts and circumstances of the case,

Patna High Court Cr.Misc. No.19720 of 2018(2) dt.19-04-2018 2/2 the petitioner, above-named, is directed to be released on bail on furnishing bail bond of Rs.10,000/-(Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Additional District and Sessions Judge-II-cum-Special Judge, (Excise) Siwan in connection with Raghunathpur P.S. Case No. 170/2017 with a condition that if the petitioner, after his release in this case, is again found involved in similar nature of cases then the concerned court would be at liberty to take steps for cancellation of his bail bonds.
