Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Admittedly, petitioner is husband of the informant and petitioner is in jail custody since 08.11.2014 in a case registered under section 498A/34 of the Indian Penal Code and 3⁄4 of the Dowry Prohibition Act.

It would appear from perusal of the impugned order of learned Additional Sessions Judge that there is no chance of reconciliation and persons from both the sides have lodged cases against each other. Moreover, petitioner has already filed Divorce Suit bearing case no. 57 of 2014 in the court of Principal Judge Family court for dissolution of marriage on the ground of mental

Patna High Court Cr.Misc. No.5869 of 2015 (2) dt.12-02-2015 2/2 condition of the informant.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Muzaffarpur in connection with Ahiyapur P.S.Case No. 706 of 2013.
