2. The petitioner has filed the present writ application for a direction to the University to pay the bills of Annual

Patna High Court CWJC No.743 of 2025(11) dt.15-12-2025 2/3 Maintenance Cost of the College Automation System Software under the Enterprise Resource Planning (ERP) for 43 constituent Colleges of the Lalit Narayan Mithila University, Darbhanga.

According to the petitioner, the University advertised tender for the college automation work under the Enterprise Resource Planning (ERP) of the university and on evaluation of technical and financial bids, the petitioner was declared as L-1 bidder for the said work. The agreement was executed between the University and the petitioner on 11.08.2021 and Work Order was issued to the petitioner on 16.08.2021. The total value of the work of college automation system has already been paid to the petitioner. The only dispute is with regard to the payment of Annual Maintenance Cost. According to the petitioner, a sum of Rs. 5,41,79,215/- is the bill amount, out of which a sum of Rs. 88 lakhs has only been paid.

Learned counsel for the University submits that the verification of the work of Annual Maintenance is being done at the University level from every colleges and about 90 lakhs has been paid to the petitioner after verification of Annual Maintenance work done by it. He further submits that the process of verification may take three to four months and after

5. Mr. Jagnnath Singh, learned counsel for the Intervenor submits that if payment is going to be made after proper verification by the present incumbent, he has nothing to say.

After having heard learned counsel for the parties and taking into consideration the nature of dispute, this writ application is disposed with a direction to the Vice Chancellor to get the work done by the petitioner examined and verified properly, towards the Annual Maintenance Cost (AMC) and if the Vice Chancellor is satisfied that the petitioner has performed the work of Annual Maintenance in the colleges, then the due amount as per the agreement, shall be paid to the petitioner. The entire exercise of verification and payment, if any, is to be done within a period of four months.

7. With the aforesaid observation and direction, this writ application stands disposed of.
