The petitioner seeks bail in a case registered under section 302 And other allied sections of the Indian Penal Code.
Informant the wife of the victim made her statement after recovery of the dead body and suspected that the petitioner along with other accused persons had greedy eyes on the land of her husband and they might have murdered her husband. Learned counsel for the petitioner submits that similarly situated co-accused Rajesh Yadav @ Rajesh Kumar Yadav has been granted bail vide Cri. Misc. No. 3843 of 2015.

Considering the fact that except suspicion the police did not collect any tangible evidence to show the involvement of the petitioner, and the fact that the other coaccused has already been granted bail, the above named petitioner is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, Bhagalpur in Madhusudanpur P.S.
