In this case, the petitioner is challenging the order dated 10.2.2017 passed by the S.D.O. cum Licensing Authority, Jhanjharpur, Madhubani, whereby and whereunder, he has cancelled the P.D.S. license of the petitioner.

Learned counsel for the petitioner submits that the petitioner was not given enquiry report and also submitted other infirmities in conducting the proceeding.

There is alternative remedy of appeal.

Let the petitioner should exhaust the alternative remedy

Patna High Court CWJC No.4048 of 2017 dt.01-11-2017 by way of filing an appeal.

If the petitioner files an appeal within a period of four weeks from today, the appellate authority will dispose of the same expeditiously. The appellate authority, while considering the issue of limitation, will take cognizance of the pendency of the present case before this Court.
