JUSTICE HARISH KUMAR ORAL ORDER 05-03-2025 Heard Mr. Purushottam Kumar Jha, learned Advocate for the petitioner and Mr. Neeraj Raj, learned Advocate for the State as well as the Accountant General.

2. The instant application is filed for initiating a contempt proceeding against the opposite parties for their willful disobedience of the order dated 06.05.2019 passed by a Bench of this Court in C.W.J.C. No. 9281 of 2019.

3. Mr. Jha, learned Advocate for the petitioner

Patna High Court MJC No.15 of 2020(2) dt.05-03-2025 2/3 referring to the order under contempt has vehemently contended that the learned Court has specifically directed the petitioner to file a detailed representation head wise before the respondent no. 1, the Principal Secretary, Department of Health, Medical Education & Family Welfare, Government of Bihar, Patna which will be disposed off within a period of three months from the date of filing of such representation. Any amount due to the petitioner along with admissible interest would be paid within one month thereafter. The Court further clarified that if certain amounts are inadmissible, the same shall be communicated to the petitioner by a speaking order sent through registered post.

4. With reference to the aforesaid order it is thus contended that there is no iota of confusion that the admissible due amount was required to be paid alongwith admissible interest.

5. This Court is afraid to accept the contention of the learned Advocate for the petitioner, inasmuch as, there is no adjudication on the point of claim of interest over the delayed payment and for the said purpose, the matter has been relegated to the respondent no. 1, who in compliance with the order of this Court has passed a reasoned and speaking order, the copy of which has been placed as Annexure A to the show cause

6. In view of the materials available on record, this Court doesn't find any reason or occasion to continue with the present contempt petition.

7. The present application stands closed with a liberty to the petitioner that if he is not satisfied with the order, he may assail the same.
