The petitioner who is mother-in-law of the deceased seeks bail in anticipation of her arrest in connection with Bajpatti P.S. Case No. 76/2018 dated 08.04.2018 instituted for the offences under Section 304(B) and 34 of the Indian Penal Code.

The allegations in the F.I.R. are general and omnibus and the petitioner is a physically challenged/differently abled person with 75% disability. In support of the aforesaid assertion, learned counsel for the petitioner has drawn the attention of this

Patna High Court Cr.Misc. No.4363 of 2019(2) dt.28-01-2019 2/2 court to Annexure-2, which is the report of the Medical Board and certificate of disability, issued by the Civil Surgeon-cum-C.M.O., Sitamarhi.

The husband of the deceased is in jail.

Considering the aforestated facts and taking into account the physical disability of the petitioner, she is directed to be released on bail, in the event of her arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, on her furnishing bail bonds in the sum of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-Divisional Judicial Magistrate, Sitamarhi in connection with Bajpatti P.S. Case No. 76/2018, subject to the conditions as laid down under Section 438(2) Cr.P.C.
