1. Heard learned counsel for the Petitioner and learned APP for the State.
2. Petitioner seeks regular bail in connection with S.T. Case No. 481 of 2023 arising out of Shahpur Patori P.S. Case No. 152 of 2022, dated 28.04.2022, registered for the offences punishable under Sections 147, 148, 149, 341, 342, 323, 324, 379, 307, 504, 506 of the Indian Penal Code and Section 27 of the Arms Act.
3. The main submissions advanced by learned counsel for the petitioner are that this is third attempt of the petitioner to get the relief of bail after his earlier two attempts for the said relief were rejected vide orders passed in Cr. Misc. Nos. 22536 of 2023 and 62840 of 2023 and he has come again
Patna High Court CR. MISC. No.4004 of 2024(2) dt.09-02-2024 2/3 in the light of the liberty granted to him in the last rejection order in which this Court observed that the petitioner may renew his bail prayer after three months from the date of that order, if no significant progress is made in his trial and before the trial Court, learned counsel appearing on behalf of the State wrongly made the submission that the petitioner's trial was at the verge of conclusion but, in actual, till date no prosecution witness has been examined and in this regard, a specific statement has been made in the petition and other accused persons have been granted anticipatory bail by a co-ordinate Bench of this Court and the petitioner has been languishing in jail since 23.02.2022 and he is a senior citizen also.
4. Learned APP appearing for the State has opposed the prayer for bail of the petitioner.
5. Considering the above submissions and mainly taking into account prosecution's lingering attitude in producing and examining the prosecution witnesses as submitted above and also coupled with the custody period of the petitioner and his old age, this Court is now inclined to accept the petitioner's prayer for bail. Accordingly, let the petitioner named-above be enlarged on bail on furnishing of bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the
